Terms of Service

1. Agreement to these Terms

These Terms of Service ("Terms") are a binding agreement between you and Prime Trail Ventures LLC, a California limited liability company ("CarSignal," "we," "us"), operator of the CarSignal mobile app and carsignalai.com (the "Service"). By using the Service you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. What CarSignal is — and is not

CarSignal uses artificial intelligence to generate estimates about a used vehicle's likely condition, history, and value from information you provide and third-party data. It is for general informational, educational, and research purposes only. It is not a professional inspection, mechanical diagnosis, safety certification, appraisal, or financial, legal, or purchasing advice. Scores and verdicts are estimates and opinions, not statements of fact about any vehicle. Always obtain an independent inspection by a qualified mechanic and verify all information before making a purchase decision.

3. Eligibility, accounts, and login

You must be at least 18 and able to form a binding contract. Login and accounts are provided through Firebase Authentication; you may sign in with the methods we offer (such as email or Google sign-in). You are responsible for activity under your account, for keeping your credentials secure, and for the accuracy of information you submit.

4. Scans, products, and usage limits

• Your first scan is free, one time per account.
• Additional usage is offered through one-time products (for example, "one more car" or "10 more questions") and may, in the future, include subscriptions. What each product grants is described at the point of purchase.
• Your access ("entitlements") is managed through RevenueCat, which records your active entitlements and lets you restore purchases across your devices and, later, across platforms. Entitlements and credits are personal to you, are not transferable or resellable, and have no cash value.
• We may change free allowances, product contents, and tiers on a prospective basis.

5. Purchases, billing, and the app stores

• All purchases of digital items are processed by the applicable app store — Google Play now, and the Apple App Store if and when CarSignal is offered on iOS — under that store's terms and payment policies. We do not receive or store your payment-card details.
• We use RevenueCat as our purchase- and subscription-management provider to validate purchases with the stores and unlock the entitlements you bought.
• By purchasing, you authorize the app store to charge your selected payment method the disclosed amount plus applicable taxes.
• Subscriptions (if offered) automatically renew at the then-current price each billing period until you cancel through your app store account; cancellation takes effect at the end of the current period, and any free trial converts to paid unless cancelled before it ends.
• Prices, bundles, and offers may change; changes apply prospectively and, for subscriptions, on the terms required by the app store and applicable law.

6. Refunds

Because the app stores process payments, refunds are handled through Google Play or the Apple App Store under their refund policies, in addition to any non-waivable statutory rights you have (for example, EU/UK consumer rights). Except where required by law, purchased products and subscription periods are non-refundable, and unused entitlements are forfeited on account closure (Section 14).

7. Acceptable use

You agree not to: circumvent, reset, or tamper with usage limits, credits, or entitlement checks; create multiple accounts to obtain extra free scans; scrape, reverse-engineer, or copy the Service; resell or commercially exploit access or outputs; upload malicious code; or use the Service to break the law or infringe others' rights.

8. Vehicle information and third-party data

The Service may incorporate or summarize data from third-party vehicle-history and market data providers. We do not control and cannot guarantee the accuracy, completeness, or timeliness of third-party data and are not responsible for it. Third-party names and marks belong to their owners; referencing them does not imply affiliation or endorsement.

9. No warranty

THE SERVICE AND ALL OUTPUTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. We do not warrant that outputs are accurate or complete or that the Service will be uninterrupted or error-free.

10. Assumption of risk and independent verification

Buying a used vehicle carries inherent risk, and you are solely responsible for your decisions. You agree to independently verify any information and obtain a professional inspection before relying on the Service for any purchase, sale, or valuation.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PRIME TRAIL VENTURES LLC AND ITS OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE SERVICE THROUGH THE APP STORES IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD $50. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

12. Indemnification

You agree to indemnify and hold harmless Prime Trail Ventures LLC from claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your misuse of the Service, your violation of these Terms, or your violation of any law or third-party right.

13. Intellectual property

The Service, including its software, design, logos, and content, is owned by Prime Trail Ventures LLC and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes.

14. Termination

You may stop using the Service and delete your account at any time (see the Privacy Policy). We may suspend or terminate access if you violate these Terms or to protect the Service or others. On termination, any unused entitlements or remaining subscription time are forfeited except where a refund is required by law or app-store policy. Sections that by their nature should survive (disclaimers, limitation of liability, indemnification) survive termination.

15. Changes

We may update the Service or these Terms. Material changes will be communicated in the app or by other reasonable means; continued use after they take effect is acceptance.

16. Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-laws rules. Subject to any binding-arbitration or small-claims terms, the exclusive venue for disputes is the state and federal courts located in Contra Costa County, California, and you waive participation in class actions to the extent permitted by law.
